Contracting Party
For payments by card, Apple Pay or Google Pay, the purchase contract for our digital products is concluded with Polar Software, Inc., 548 Market St, PMB 61301, San Francisco, CA 94104, USA, acting as reseller (Merchant of Record) (see Section 3 of our Terms and Conditions). For payments via PayPal and purchases on invoice (see Section 5 of the Terms), the contract is concluded directly with Max Fischer, MXF Labs. The following notice applies to consumers within the meaning of Section 13 of the German Civil Code (BGB).
Right of Withdrawal
Consumers have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.
To exercise your right of withdrawal, you may at any time declare the withdrawal to us (Max Fischer, MXF Labs, Lammersdorfer Straße 2, 52159 Roetgen, email: [email protected]) by means of a clear statement (for example an email) informing us of your decision to withdraw from this contract. For a purchase by card, Apple Pay or Google Pay you may also declare the withdrawal to Polar Software, Inc. (for example via the contact channels stated in your payment confirmation from Polar); if you declare it to us for such a purchase, we will forward it to Polar without delay.
Early Expiry of the Right of Withdrawal
In the case of a contract for the supply of digital content not delivered on a tangible medium, the right of withdrawal expires if we have begun performing the contract after you have expressly consented to us beginning performance before the end of the withdrawal period, you have confirmed your awareness that you lose your right of withdrawal by giving this consent once performance begins, and we have provided you with a confirmation of the contract pursuant to Section 312f of the German Civil Code (BGB) (Section 356(6) BGB).
Voluntary Money-Back Guarantee
Independently of the statutory right of withdrawal, we offer a voluntary 14-day satisfaction guarantee. To make use of it, simply contact [email protected] (no particular form required).
Effects of Withdrawal
In the event of an effective withdrawal, all payments received will be refunded to you without delay and no later than fourteen days from the day on which the notice of your withdrawal was received. The refund is made via the original payment method (Polar or PayPal).
