The manufacturer: whoever makes packaging or packaged products, or has them designed or made, under their own name or brand; for sales packaging this is normally the filler. Importers and distributors become the manufacturer when they place packaging on the market under their own name or brand or modify it in a way that could affect conformity (Art. 21 PPWR). Importers without their own brand issue no declaration; they check the manufacturer's and keep a copy (Art. 18). Pure distributors only check registration, labelling and the manufacturer and importer details on the packaging (Art. 19). Exception: if the brand owner is a micro-enterprise and its packaging supplier is located in the same Member State, the supplier counts as the manufacturer.

Since 12 August 2026. There is no transition period. Since that date, packaging may only be placed on the EU market with a valid Declaration of Conformity.

A unique identification of the packaging, the name and address of the manufacturer, the conformity statement per Art. 39 and Annex VIII PPWR, a reference to the technical documentation, and place, date and signature. PPWR-DOC asks for each of these mandatory fields step by step.

No. Packaging is not subject to CE marking. No CE mark and usually no notified body is required — assessment is done via internal production control (Module A).
