From 12 August 2026, no packaging may enter the EU without a Declaration of Conformity
The EU Packaging Regulation (PPWR, Regulation (EU) 2025/40) requires everyone who places packaging on the market to hold an EU Declaration of Conformity. Without this document, your packaging may no longer be marketed in the EU after the cut-off date. Upon a reasoned request from the national authority, you must provide the evidence — including the declaration of conformity — within ten days (Art. 15(10) PPWR).

Without a Declaration of Conformity, affected packaging may no longer be placed on the market from 12 August 2026.
Substantial fines¹
German packaging law already provides fines of up to €200,000 for serious violations today (Section 36 VerpackG). The specific PPWR penalties will be set by EU member states by February 2027 — effective, proportionate and dissuasive.¹

Frequently asked questions
Who must create the PPWR Declaration of Conformity?
Every manufacturer of packaging — including fillers and importers, as well as distributors and brands placing packaging on the market under their own name. Importers and distributors under a private label are legally treated as the manufacturer per Art. 21 PPWR and must issue their own declaration. Exception: micro-enterprises sourcing from an EU-based packaging supplier — then the supplier counts as the manufacturer.
When does the obligation apply?
From 12 August 2026. There is no transition period. From that date, packaging may only be placed on the EU market with a valid Declaration of Conformity.
What must the declaration contain?
A unique identification of the packaging, the name and address of the manufacturer, the conformity statement per Art. 39 and Annex VIII PPWR, a reference to the technical documentation, and place, date and signature. PPWR-DOC asks for each of these mandatory fields step by step.
Is the document created by PPWR-DOC legally sound?
The document follows the exact structure of Art. 39 and Annex VIII of Regulation (EU) 2025/40 — no mandatory element is missing formally. The factual accuracy of your input and the underlying technical documentation remains your responsibility as the manufacturer, as with any declaration of conformity under EU product law. Do I need a separate declaration per packaging?

How long must I keep the declaration?
For single-use packaging 5 years, for reusable packaging 10 years from placing on the market.
What about the technical documentation per Annex VII?

Do I need CE marking?
No. Packaging is not subject to CE marking. No CE mark and usually no notified body is required — assessment is done via internal production control (Module A).
Do I get an invoice?
